This Engagement Agreement outlines the terms under which Trademarkings Inc. ("We," "Us") will provide services to you ("Client").
By proceeding with payment or submission of our online forms, you confirm that you have read and agreed to these terms.
1. Nature of Services
Trademarkings Inc. is a trademark firm that employs or sub-contracts registered trademark agents, licensed attorneys, paralegals,
and assistants to provide professional trademark filing and related services.
While we are not a law firm, all trademark applications are prepared, reviewed, and filed by licensed trademark attorneys
to ensure quality and compliance with jurisdictional requirements. We do not offer legal advice unless explicitly provided by a licensed attorney
through separate engagement or referral.
2. Scope of Services
We will assist with the preparation, filing, and management of your trademark application(s). The specific services and fees are listed on our
pricing page. Additional fees may apply for services outside the agreed scope.
Registration of a trademark is not guaranteed, as this depends on decisions made by government authorities. If an issue arises with your application,
we will provide guidance and, where applicable, a fixed-fee quote for additional actions.
3. Client Responsibilities
You agree to provide accurate, timely, and complete information and cooperate as necessary for us to fulfill the agreed services.
We are not liable for delays, rejections, or issues caused by incomplete or inaccurate information.
4. Fees and Refunds
Fees are detailed on our pricing page and are generally non-refundable.
If a refund is requested within 48 hours of payment and no work has been performed, a full refund may be issued. For refunds after work has commenced,
partial refunds may be offered at our discretion.
Government fees are additional and non-refundable.
5. Limitations of Liability
While we will use reasonable efforts to support your application, we are not responsible for the outcome of the trademark process, including rejections,
oppositions, or other actions by government authorities or third parties. Trademarkings Inc. is not liable for any losses resulting from reliance on our services.
6. Entire Agreement
This document, together with any referenced pages, constitutes the entire agreement between us.
No other statements or representations will modify this agreement unless in writing and agreed to by both parties.
